  1. Who we are

    The website BuySellCar.online (the “Website”) and related services (together, the “Services”) are operated by:

    References in these Terms to “we”, “us” or “our” mean Liko s.r.o.

    References to “you” or “user” mean any person accessing or using the Website or Services.

    By accessing or using the Website, you agree to be bound by these Terms and Conditions (the “Terms”). If you do not agree with these Terms, you must not use the Website.

  2. Scope of the Services

    1. BuySellCar.online is an online marketplace platform that allows users to publish, browse and manage listings for vehicles and related products or services (for example, cars, motorcycles, spare parts, etc.).
    2. We provide only the technical platform. We are not a party to any contracts or transactions between users (e.g. between buyers and sellers) and we do not act as agent, dealer, broker or insurer.
    3. We do not own, inspect or guarantee the vehicles or items listed on the Website. All information in listings is provided by users.

  3. Eligibility

    1. You may use the Website only if you:
      • are at least 18 years old (or have full legal capacity under the laws of your country), and
      • have the right to enter into binding agreements.
    2. By creating an account or using the Services, you represent and warrant that you meet these requirements and that all information you provide is accurate and truthful.

  4. User accounts

    1. To publish listings or use certain features, you may need to create a user account. You must keep your login details confidential and not share them with third parties.
    2. You are responsible for all activities occurring under your account. If you suspect any unauthorised use, you must inform us without undue delay.
    3. We may refuse registration, suspend or terminate accounts at our reasonable discretion, in particular where we believe that these Terms or applicable laws have been violated.

  5. Listings and user content

    1. Users are solely responsible for the content of their listings and other information they post or upload (including text, photos, videos, contact details and any other data, together “User Content”).
    2. You agree that you will not publish any User Content that is:
      • false, misleading or deceptive;
      • illegal, offensive, discriminatory or otherwise inappropriate;
      • infringing any intellectual property, privacy, publicity or other rights of third parties;
      • spam, unsolicited advertising or repetitive content;
      • containing malware, viruses or other harmful code.
    3. You are responsible for ensuring that your listings comply with all applicable laws and regulations in the countries where you operate or where your listing is targeted (for example, consumer protection, advertising, tax, vehicle registration rules).
    4. We reserve the right (but have no obligation) to review, edit, refuse or remove any User Content at our discretion, especially where we believe it violates these Terms or applicable law.

  6. Prices, payments and paid services

    1. Basic browsing of listings is typically free of charge. We may offer paid services (for example, highlighted listings, promotional placements or subscriptions).
    2. The applicable prices, billing periods and payment methods will be displayed on the Website before you place an order.
    3. By purchasing a paid service, you agree to pay the indicated price and any applicable taxes. Payments are processed via third-party payment providers; we do not store full card details.
    4. Unless stated otherwise, fees for paid services are non-refundable, except where required by applicable consumer law.

  7. Relationship between users

    1. Any communication, negotiation, contract or transaction between users (such as buyer and seller) takes place exclusively between those users.
    2. We are not responsible for:
      • the existence, quality, safety, legality or conformity of vehicles or items;
      • the accuracy or completeness of listings;
      • the performance or behaviour of any user;
      • payment, delivery, registration, insurance or any other obligations between users.
    3. You should carefully evaluate the other party and the item before entering into any agreement, and you are advised to obtain independent professional advice where appropriate.

  8. Intellectual property

    1. The Website, including its design, logo, software, and content created by us, is protected by copyright and other intellectual property rights. You may use it only for personal and non-commercial purposes related to using the marketplace.
    2. By posting User Content, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display and otherwise use such content on the Website and in connection with promoting the Services, for as long as your content is available on the platform and for a reasonable period thereafter (for example, for backup and legal purposes).
    3. You confirm that you have all necessary rights to grant this licence and that your User Content does not infringe any third-party rights.

  9. Prohibited uses

    You agree not to:

    1. use the Website for any unlawful purpose or in violation of these Terms;
    2. scrape, crawl or systematically collect data from the Website without our prior written permission;
    3. circumvent or attempt to circumvent any technical protection measures or security features;
    4. interfere with the proper functioning of the Website or attempt to overload it (e.g. via automated tools);
    5. impersonate any person or misrepresent your affiliation with any person or entity.

  10. Availability and changes to the Services

    1. We strive to keep the Website available and functioning, but we do not guarantee uninterrupted access. Maintenance, security updates or technical issues may temporarily affect availability.
    2. We may modify, suspend or discontinue parts of the Services at any time, provided that such changes do not unreasonably prejudice users who have already paid for specific services, in which case we will seek a fair solution (e.g. extension or partial refund, where required by law).

  11. Liability

    1. The Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we do not provide any warranties, express or implied, regarding the Website, the Listings or any transactions between users.
    2. In particular, we do not warrant that:
      • listings or User Content are accurate, complete or up to date;
      • any vehicle or item will meet your expectations;
      • any transaction will be successfully concluded.
    3. To the maximum extent permitted by applicable law, we shall not be liable for:
      • any indirect, consequential, incidental or punitive damages;
      • loss of profit, revenue, business or data;
      • damages arising from contracts or transactions between users.
    4. Nothing in these Terms limits or excludes our liability where it cannot be limited or excluded under applicable law (for example, for gross negligence, intentional misconduct or statutory consumer rights).
    5. We use reasonable technical and organisational measures to operate and maintain the Website; however, we do not guarantee that the Website will be free from errors, interruptions, delays, or data loss. To the maximum extent permitted by law, we shall not be liable for any loss of data, User Content, listings, messages, settings or other information resulting from technical failures, server issues, maintenance operations, software errors, third-party service outages, or other events outside our reasonable control. It is your responsibility to keep backup copies of any information or content you wish to preserve.

  12. Indemnity

    You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising out of or related to:

    • your use of the Website;
    • your breach of these Terms;
    • your violation of any law or third-party rights;
    • your User Content or listings.

  13. Termination

    1. You may stop using the Website at any time and request deletion of your account, subject to our data retention obligations described in the Privacy Policy.
    2. We may suspend or terminate your access to the Website or your account at any time, with or without notice, if we reasonably believe that you have breached these Terms or applicable law, or if we decide to discontinue the Services.
    3. Upon termination, your right to use the Services ceases, but the following sections of these Terms will continue to apply: intellectual property licence (for content already used), liability, indemnity, and any other provisions which by their nature should survive termination.

  14. Governing law and jurisdiction

    1. These Terms and any disputes arising out of or in connection with them shall be governed by the laws of the Slovak Republic, without regard to its conflict of law rules.
    2. If you are a business user, you agree that the courts of the Slovak Republic shall have exclusive jurisdiction over any such disputes.
    3. If you are a consumer and mandatory consumer protection laws provide you with the right to bring claims in your country of residence, this clause does not limit those rights.

  15. Changes to these Terms

    1. We may update these Terms from time to time, for example to reflect changes in the law or in our Services.
    2. The updated version will be published on this page with a new “Last updated” date. If we make material changes, we may also notify you by email or via the Website.
    3. Your continued use of the Website after the updated Terms become effective will constitute your acceptance of the changes. If you do not agree with the new Terms, you must stop using the Services.
